These Terms of Service ("Terms") govern your access to and use of the Nitta Quiz mobile application, our website, and related services (collectively, the "Service") provided by Nitta Quiz ("we", "us", "our").

By creating an account, downloading the App, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, e.g., 16 in parts of the EU) to use the Service. By creating an account, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are under the age of majority in your country, you must have a parent or legal guardian's consent.

2. Your account

2.1 Sign-in and security

The Service uses passwordless authentication: when you sign in we send a 6-digit code to your email address. Keep your email account secure — anyone with access to your inbox can sign in to the Service.

2.2 Account information

You agree to provide accurate information (such as your first name and country) and to keep it up to date in Settings → Account settings. You are responsible for activity under your account.

2.3 One account per person

You may not create multiple accounts to gain unfair advantages, ranking inflation, or duplicate rewards.

2.4 Account deletion

You may delete your account at any time — in the app via Settings → Account settings → Danger zone → Delete account, or on the web from our account deletion page. Requesting deletion starts a 15-day recovery window; during that time you can cancel and restore your account by signing back into the app. After 15 days, your account and its data — progress, history, achievements, badges, and unspent in-game currency — are permanently erased, subject to the retention rules described in our Privacy Policy.

3. License to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on devices you own or control, solely for personal, non-commercial entertainment.

4. Acceptable use

You agree not to:

  • Cheat, exploit bugs, or use bots, scripts, or third-party tools that interact with the Service in ways not provided by the App's user interface.
  • Tamper with the App's binary, network traffic, or local data; reverse-engineer except to the limited extent allowed by law.
  • Use the Service to harass, threaten, defame, or harm others, including via your profile name, photo, or bio.
  • Upload content that is unlawful, infringing, obscene, hateful, or that violates third-party rights.
  • Submit content (in your name, bio, or avatar) that contains personal data of others without their consent.
  • Sell, trade, or transfer your account, in-game currency (crowns, gems), items, or rewards outside the Service.
  • Probe, scan, or test the vulnerability of the Service, or attempt to bypass authentication, rate limits, security, or feature gating (including feature flags).
  • Use automated means to scrape, crawl, or extract data from the Service.
  • Engage in fraudulent purchases, chargebacks without cause, or refund abuse.

We may suspend or terminate accounts that violate these rules without prior notice.

5. User content

You may submit content to the Service such as your first/last name, profile photo, and short bio. You retain ownership of your content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and use that content as needed to operate the Service (for example, showing your name and avatar on leaderboards).

You represent that your content does not violate the law or third-party rights and complies with Section 4.

We may remove content that we believe violates these Terms, and we may refuse to display content that, in our reasonable judgment, is inappropriate.

6. The in-game economy

6.1 Lives, gems, and crowns

The Service uses three in-game systems:

  • Lives — consumed when you answer questions incorrectly. Lives refill over time, can be earned by watching a rewarded ad, or refilled with gems.
  • Gems — a premium currency used to refill lives, buy boosters, and obtain other items. Gems may be earned in the Service or purchased through in-app purchases.
  • Crowns — earned by playing quizzes and used to compete on the leaderboard. Crowns are not redeemable for cash and are not purchasable.

6.2 No real-world value

Gems, crowns, lives, boosters, and other in-game items are licensed to you for personal use. They have no monetary value, are not transferable outside the Service, cannot be exchanged for real money, and cannot be redeemed for goods or services outside the Service. We may modify, regulate, or remove items and currencies at any time at our sole discretion (for example, balance changes for fairness or fraud prevention).

6.3 Daily check-ins, streaks, and rewards

Daily check-in rewards must be claimed within the period shown in the App. Streaks reset if you do not play at least one quiz within a 24-hour window. We may run limited-time promotions and adjust their availability without notice.

7. In-app purchases and subscriptions

7.1 Purchases

The App offers in-app purchases such as the Starter Pack ($0.99 one-time) and Nitta Unlimited subscriptions (e.g., $4.99/month or $39.99/year). Purchases are processed by Apple App Store or Google Play and are subject to their terms and refund policies.

7.2 Subscriptions

  • Subscriptions auto-renew at the end of each billing cycle unless you cancel at least 24 hours before renewal.
  • You can manage and cancel subscriptions in your Apple ID or Google Play account settings.
  • Cancelling stops future renewals but does not refund the current billing period.
  • Benefits described in the App (e.g., unlimited lives, 2× rewards, ad-free) apply only while the subscription is active.

7.3 Refunds

All purchases are final once delivered. Refund eligibility is determined by Apple or Google according to their store policies. We are unable to issue refunds for purchases processed by the stores. Where local law grants you a statutory right of withdrawal, you may waive it by starting to use a digital item immediately after purchase; otherwise contact privacy@nittaquiz.com.

7.4 Pricing and taxes

Prices may change. We will give reasonable notice before any change applies to existing subscriptions. Prices may include local taxes depending on your region.

8. Advertising

The free version of the App is supported by ads, including interstitial and rewarded video ads (for example, watch an ad to earn a free life). By using the free version you agree to be shown ads. Subscribing to Nitta Unlimited removes most ads as described in the App. Optional rewarded ads remain available so you can voluntarily watch them in exchange for an in-game reward.

9. Leaderboards and competitive play

Leaderboards display public information about other users (first name, avatar, country, score). We may reset or recalculate leaderboards to remove cheating, fraud, or technical errors. We may exclude or remove accounts that violate these Terms.

10. Feature availability and changes

The Service evolves. We may add, modify, suspend, or remove features (for example, ranking, missions, or specific quizzes) at any time. Some features are gated behind feature flags and may not be available to all users at all times. We are not liable for features that are unavailable, removed, or changed.

11. Beta features

We may label some features as "beta", "preview", or "coming soon". These are provided "as is", without warranty, and may change or be removed at any time.

12. Intellectual property

The Service, including the App, the Site, the brand, the question content we author or curate, designs, audio, graphics, and code, is owned by us or our licensors and is protected by copyright, trademark, and other laws. Except for the limited license in Section 3 and the rights granted by law, no rights are transferred to you.

If you believe content on the Service infringes your copyright, send a notice to legal@nittaquiz.com containing the information required by the Digital Millennium Copyright Act (DMCA) or your local equivalent.

13. Third-party services

The App integrates with third-party services, including Apple App Store / Google Play (distribution and purchases), Supabase (auth, database, storage), Google AdMob (ads), and Sentry (crash reporting). Your use of those services may be subject to their separate terms and privacy policies.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, engaged in fraud, abused the in-game economy, or otherwise put the Service or other users at risk. You may terminate your account at any time by deleting it in Settings.

Upon termination, your license to use the Service ends immediately. Sections that by their nature should survive termination (for example, Sections 6, 12, 15, 16, 17, 18) survive.

15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT IT WILL MEET YOUR EXPECTATIONS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NITTA AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR IN-GAME ITEMS, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID NITTA IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) USD $50.

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW (FOR EXAMPLE, FOR GROSS NEGLIGENCE, WILFUL MISCONDUCT, FRAUD, OR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE).

17. Indemnity

You agree to defend, indemnify, and hold harmless us and our affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) your content, or (d) your violation of any law or third-party right.

18. Governing law and dispute resolution

These Terms are governed by the laws of the jurisdiction in which we are established, without regard to conflict-of-laws principles. The competent courts of that jurisdiction have exclusive authority over disputes arising out of or relating to these Terms, except that consumers may bring claims in the courts of their own country where required by law.

If you reside in the EU, nothing in this Section deprives you of the protection of mandatory consumer-law provisions of your country of residence.

19. Apple-specific terms

If you use the App on iOS:

  • These Terms are between you and us, not Apple. Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support.
  • If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

20. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date and, for material changes, notify you in the App or by email at least 30 days before they take effect. Continued use of the Service after that date constitutes acceptance.

21. Miscellaneous

  • Entire agreement. These Terms (together with the Privacy Policy and any in-app notices) are the entire agreement between you and us regarding the Service.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
  • No waiver. Our failure to enforce any provision is not a waiver.
  • Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Notices. We may give notice through the App, the Site, or your email on file.
